Overview

Welcome to Ken & Glen! The terms "we", "us" and "our" refer to Ken & Glen, a trade name of KP Ecom, a company registered in the Netherlands (KvK 81952279). Ken & Glen operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Ken & Glen is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service ("Terms"), together with any policies referenced herein, describe your rights and responsibilities when you use the Services. Please read them carefully. Nothing in these Terms limits or excludes any rights you have as a consumer under UK law that cannot be limited or excluded by agreement.

Section 1 – Access and account

By agreeing to these Terms, you confirm that you are at least the age of majority in your place of residence. To use certain parts of the Services you may need to provide accurate and complete information, such as your email address and delivery details. You are responsible for keeping your account credentials secure and for all activity on your account.

Section 2 – Our products

We make every effort to show our products as accurately as possible, including their colours, materials and sizing. Colours may appear slightly different depending on your screen. Product descriptions and size information are provided to help you choose. If a product is not as described, you have the rights set out in our Refund Policy and under the Consumer Rights Act 2015.

Section 3 – Orders

When you place an order, you make an offer to buy the products. A contract is formed when we confirm your order by email. We may refuse or cancel an order, for example if a product is unavailable, a pricing error has occurred or we suspect fraud. If we cancel an order after payment, we will refund you in full.

Section 4 – Prices and payment

All prices are shown in pounds sterling (GBP). Delivery within the UK is free. The total price of your order is shown at checkout before you pay. For information about import charges on orders above £135, please see our Shipping Policy. Prices may change, but changes will not affect orders already confirmed. You agree to provide current, complete and accurate payment information. Payment is taken when you place your order. See our Payment Policy for more information.

Section 5 – Shipping and delivery

Estimated delivery times are shown in our Shipping Policy. Delivery times are estimates and may be affected by carriers, customs processing or events outside our control. If your order is not delivered within 30 days of the estimated delivery date, you may cancel it and receive a full refund. Risk of loss passes to you upon delivery to the address you provided.

Section 6 – Returns and cancellations

You may cancel your contract and return products within the periods and under the conditions set out in our Refund Policy, which includes your statutory 14-day right to cancel under the Consumer Contracts Regulations 2013.

Section 7 – Intellectual property

The Services, including all trademarks, text, images, graphics, product reviews and the design and arrangement thereof, are owned by Ken & Glen, its affiliates or licensors and are protected by copyright, trademark and other intellectual property laws. You may use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify or republish any material from the Services without our prior written consent. Shopify's name and logo are trademarks of Shopify. All other names and logos are the trademarks of their respective owners.

Section 8 – Optional tools and third-party links

We may provide access to tools or links to websites operated by third parties, which we do not monitor or control. Your use of such tools and websites is at your own discretion and subject to the third party's own terms and policies.

Section 9 – Relationship with Shopify

Ken & Glen is powered by Shopify, which provides our online store platform. Shopify is not a party to these Terms and is not responsible for the products or services we sell. Your use of Shopify's services may be subject to Shopify's own terms.

Section 10 – Privacy

Your personal information is processed in accordance with our Privacy Policy.

Section 11 – Reviews and feedback

If you submit reviews, comments or other content, you confirm that it is accurate, your own and does not infringe the rights of others or contain unlawful, offensive or misleading material. You grant us a non-exclusive, royalty-free licence to use, display and publish that content in connection with the Services. We may remove content at our discretion.

Section 12 – Errors and inaccuracies

Occasionally information on the Services may contain errors relating to product descriptions, pricing or availability. We reserve the right to correct such errors and to update information at any time. If an error affects an order you have placed, we will contact you before proceeding, and you may cancel for a full refund.

Section 13 – Prohibited uses

You may not use the Services for any unlawful purpose; to infringe our intellectual property or that of others; to harass, abuse or discriminate; to submit false or misleading information; to upload viruses or malicious code; to collect personal information of others; or to interfere with the security of the Services.

Section 14 – Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses, as our products are supplied for private use only. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your statutory rights under the Consumer Rights Act 2015.

Section 15 – Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control. If such an event affects your order, we will contact you as soon as possible, and you may cancel for a full refund of any products not yet delivered.

Section 16 – Termination and severability

We may suspend or end your access to the Services if you breach these Terms. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Section 17 – Governing law and disputes

These Terms are governed by the laws of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts, and you will always benefit from the mandatory consumer protection laws of the part of the UK where you live.
